In Philadelphia, on the other hand, traffic matters are handled exclusively by the Philadelphia Traffic Court. As is the case with the district courts, cases in Traffic Court are heard by judges alone. However, unlike the district courts, the officer who gave you the ticket rarely appears. Rather, a court liaison officer from the Philadelphia Police Department will attend who will read the facts presented on the ticket. You will then have your opportunity to tell your side of the story. Again, it is very helpful to have an attorney at this stage, as an attorney is likely to be more conversant and cognizant of the Vehicle Code and, as a result, is likely to argue your case more effectively.
Another significant difference is that there is less opportunity for negotiation in Philadelphia Traffic Court. As is the case outside of the city, you can appeal to the Court of Common Pleas for a new trial. At that point, the matter is handled by the District Attorney’s office which may be amenable to a reasonable negotiation.
