The immigrant is a highly-regarded researcher at a local university. Initially charged with an assault charge, Mr. Johnston was able to negotiate an appropriate plea agreement with the suburban district attorney’s office in which his client pleaded guilty to a low-level summary disorderly conduct charge. Three years later, he represented the immigrant again, this time in his efforts to become a United States citizen. Mr. Johnston and his client convinced USCIS that the disorderly conduct charge was very much an isolated incident and that the immigrant is otherwise a good member of the community who dutifully supports his family, performs valuable work and is worthy of citizenship. USCIS approved the application and, as a result, his client is now a citizen.
