Attorney Peter L. Johnston, Esquire represented a young Philadelphia man who was arrested as a passenger in a vehicle that turned out to be stolen one half hour earlier. Despite the gap in time, the fact that his client was just a passenger and there was no evidence linking him to the theft at the time and place that it happened, the case was held for court at a preliminary hearing. However, Mr. Johnston subsequently filed a Motion to Quash the Indictment and argued it in the Court of Common Pleas. In the end, Mr. Johnston convinced the judge that Commonwealth failed to make out a case against his client and the Court granted the motion and dismissed the charges against his client.
