CLIENT SUCCESS STORY: Recovery for woman’s knee injury

 

Attorney Peter L. Johnston represents a Philadelphia woman who was injured after she tripped and fell over an uneven supermarket display.  Soda bottles of varying heights were stacked upon one half of a wooden pallet.  The display of bottles and the shopping cart she pushed (and was reasonably expected to push at the time) obscured the woman’s view of the part of the pallet that had no bottles stored on it and she tripped and fell on that part of the pallet after she turned to shop for items on the other side of the supermarket aisle.  Woman suffered a torn meniscus in her knee which did not require surgery.  Insurance company fiercely defended the matter claiming it only had nuisance value of $1,500.00 and that she was at fault and that her injuries were not serious and were caused by prior arthritic conditions.  However, at a pretrial conference, Mr. Johnston effectively pointed to evidence and medical records to the contrary and ultimately obtained for his client a $46,000.00 settlement for her her pain and suffering, a vastly significant increase from the insurer’s original offer of settlement.
